1.1. These Terms and Conditions (“Terms and Conditions”) set out the rules for the use of the Pure Power of Energy (“Czysta Moc Energii”) website (the “Website”) owned by Respect Energy Holding S.A. (“REH” or “Administrator”) available at [czystamocenergii.pl].

1.2. The Website is operated by Respect Energy Holding Spółka Akcyjna, with registered office in Warsaw 00-203, ul. Bonifraterska 17, entered in the Register of Entrepreneurs kept by the District Court for the Capital City of Warsaw, XIV Business Division of the National Court Register, under the following numbers: KRS 0001016150, REGON 366078501, NIP 9522154698, e-mail address: czystamocenergii@respect.energy

1.3. These terms and Conditions have been drawn up by Respect Energy Holding S.A.

  1. Definitions

2.1. User – the natural person, legal entity or organisation using the Website.

2.2. Administrator – Respect Energy Holding S.A. responsible for administering the Website.

2.3. Content – all text, graphic, multimedia and other materials published on the Website.

2.4. Terms of Participation/Terms of Use – a set of terms and conditions that define how educational activities, grant competitions and others are to be carried out.

  1. Scope of operation and purpose of the Website

3.1. The purpose of the Website is to educate and promote reliable, science-based knowledge on:

    • renewable energy sources, their role and their contribution to the energy transition process

    • protecting the environment and the planet,

    • climate change and how to counteract or minimise its negative effects.

3.2. The objectives of the Website are achieved by providing access to text, graphic and multimedia materials on the topics specified in 3.1. above.

3.3. Using the Website, REH may announce and carry out any activities that fulfil the objectives of point 3.1 including competitions, educational activities, and grant programmes.

3.4. The use the Website by the users is free of charge, including its content, available tools and functionalities.

  1. Terms of the Website use

4.1. 4.1 The Terms and Conditions set out the conditions under which REH allows the use of the Website free of charge.

4.2. By using the Website, the User agrees to be bound by these Terms and Conditions. The User undertakes to use the Website in accordance with applicable law and the provisions of the Terms and Conditions of Use.

4.3 The Administrator provides contact forms that collect personal data in order to enable participation in the activities referred to in section 3.3 of these Terms and Conditions. The rules for the collection and use of personal data are specified in the Website’s Privacy Policy.

4.4 All content and activities provided on the Website are subject to these Terms and Conditions of Use, with the exception of those that are governed by separate regulations.

4.5 For the proper and full use of the Website, Users should have at their disposal: a computer or other device with access to the Internet with an operating system supporting popular web browsers and cookie files.

6.1. The Administrator makes every effort to ensure that the Content on the Website is up-to-date and correct, however, it shall not be held liable for any incorrect or outdated content.

6.2. The Administrator shall not be held liable for interruptions in the operation of the Website resulting from technical reasons or reasons beyond the Administrator’s control.

6.3. The User shall be liable for using the Website in a manner inconsistent with the Terms and Conditions of Use or applicable laws.

7.1. All Content posted on the Website is protected by copyright and is the property of Respect Energy Holding S.A. or relevant third parties.

7.2. The copying, distribution or use of Content without acknowledgement of its source is prohibited.

8.1. The data controller within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (General Data Protection Regulation – GDPR”) collected through the Pure Power of Energy (“Czysta Moc Energii”) Website is Respect Energy Holding S.A. with its registered office in Warsaw, ul. Bonifraterska 17, 00-203 Warsaw (hereinafter referred to as “Data Controller”).

The Data Controller shall apply appropriate technical and organisational measures to protect the personal data of the Users of the Website.

8.2.In matters related to the processing of personal data and the rights of data subjects concerning the processing of data on the Pure Power of Energy (“Czysta Moc Energia”) Website, you can contact the Controller by writing at the Controller’s registered office address stated in 8.1 above.

8.3. The Data Controller is responsible for ensuring the security of the personal data provided and for processing them in accordance with the law.

8.9. Each person shall also have the right to lodge a complaint to the supervisory authority, i.e. the President of the Office for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw if he/she considers that the Data Controller processes their data inappropriately.

8.10 The recipients of the data may be entities authorised by law processing the data on behalf of the Data Controller (e.g. technical service providers, and consultancy service providers).

8.11 Data will not be transferred to recipients located in countries outside the European Economic Area.

9.1 The Administrator reserves the right to make changes to these Terms and Conditions of Use. Users will be informed of any such changes through publication of the new version of the Terms and Conditions on the Website.

9.2. In matters not regulated by these Terms and Conditions of Use, the applicable provisions of Polish law shall apply.

9.3. Any disputes arising from the use of the Website shall be settled by the common courts with appropriate jurisdiction.
